It’s official Kurt Warner QB for the Arizona Cardinals has just retired after 12 great years in the NFL. Warner was always one of the top professional NFL players on and off the field and spent a lot of his time during the off-season helping out with different charities. During his career Warner won two MVP awards, went to the Pro bowl 5 times and won the Super Bowl with the St. Louis Rams early in his career. Even though he had 2 years and million left on his contract, he felt this was the perfect time for him to walk away from the game.

The Cincinnati Bengals rookie LB Rey Maualuga has been arrested for DUI after he hit a parking meter and 2 park cars early this morning. But after learning about this the only thing that has me puzzled since athletes get DUI all the time is why is he still driving a 2003 Pontiac.

This Sunday night is the 2009-10 NFL Pro Bowl that will be held in Miami instead of the usually place Hawaii. Another difference is that this year’s game is the week before the Super Bowl instead of after, which makes all the players in the Super Bowl that made it to the Pro Bowl not eligible. But because the rule states that even if you cant play in the Pro Bowl if you made the team you must make an appearance which has angered many Indianapolis Colts and New Orleans Saints players that have to miss their teams flight in order to fulfill their duties under league rules.

The weekend the top seniors in college football will suit up for the North and South and battle it out in this year Senior Bowl. While there is a lot of marquee players in the game the most hyped up player competing is Florida Gators QB Tim Tebow. Tebow won many accolades during his tenure at Florida but many experts predict that he will not make a good QB in the NFL. Many feel he has a better chance as a tight end due to his lack of arm strength that is needed to succeed in the NFL. However Tebow plans on proving people wrong this weekend in front of every NFL scout that thinks he should look at playing another position. Just to make things worst Tebow was diagnosed with streap throat this week and was running a 103-degree temperature on Wednesday.

While in the beginning the match up seemed like Joe-Wilfried Tsonga had a chance but quickly we all realized that he was no match for Roger Federer who cruised to a 6-2,6-3,6-2 win today to advance to the finals. Federer will meet up with Andy Murray in the finals on Sunday.

Once again on the women’s double side the Williams sisters Serena and Venus have won their 4th doubles final at the Australian Open. On top of that Serena is also headed to the singles final against Justine Henin on Saturday.

During the 2007 fiscal year, from July 1 to June 30, there were 36 collisions at the intersections. In fiscal 2008, there were 73. The numbers over doubled after placing photo radar on this corner. Councilman Ron Aames from the Palo Verde District said the increase suggests that the cameras might actually be making intersections more dangerous. Aames replied, “I’m thinking if these numbers were reversed . . . I probably wouldn’t hear these other ways of explaining it. “I don’t want this to be a situation where we’re just giving tickets to people and not really making the roads safer.”

Story from a friend traveling across Arizona: Thirty miles outside Flagstaff on Interstate 40, an RV broke down while they were traveling across the country this summer. They desperately tried to contact their towing company, but due to limited cell service they could not reach them. We were able to get 911, who said they would call towing. They also informed us that since it was Sunday, we’d have to wait for some time. That was the last we ever spoke to the police. The temperature was well over 90 degrees and storm clouds were swirling above. In the hours we waited outside in the heat, not one car stopped to inquire if they needed help. Better yet, not one state trooper or patrol car came by to check to see if they were OK. Where is our state highway patrol? Are we running a Department of Public Safety or a Department of Public Photo Enforcement? What they did see frequently as they traveled our roads were police cruisers taking pictures of people speeding. What about people who have the misfortune of breaking down on your highways — are there no police available to lend a hand because they are out there taking pictures?  Keeping the public safe from aggressive drivers is important, but coming to the aid of stranded motorists is just as important if not more so.

From listening to both sides of the photo radar controversy for some time now, I’ve yet to find an educated opinion when it comes to supporting photo radar.  Not only is this state driving vacationers away, but it’s driving its own home grown citizens out. Police officers pretending to be the kings of law on every corner, it’s scarier than downtown phoenix. Performing unlawful searches and falsifying breathalyzer reports, it’s hard to support such a government. One wonders if the statistics were available, which would make more money, the combination of dui and photo radar revenue, or the high priced taxed goods purchased by wealthy visitors. Instead of pissing off the entire state, why not set up a healthier process.  While we all know photo radar is just another “play on taxes” (Tax given a safety spin to get citizens to pay) we should be thinking of real solutions to Arizona’s debt issue. Power hungry politicians and law enforcement will only drive out what’s left of such a beautiful state.

If your test results indicate a result of .08% or higher, the police will seize your Arizona driver license, and issue you a temporary license which is valid for 15 days, or, if you request a hearing within the 15 day window, until the hearing is conducted and the outcome determined. You must check the box indicating you are requesting an Administrative Hearing and mail it, within 15 days of service to you by the police, to: Arizona Department of Transportation, Executive Hearing Office, Mail Drop 507M, P.O. Box 2100, Phoenix, AZ 85001-2100. Do not select Summary Review; this will not get you a hearing, but merely a review of the paperwork submitted by the police.

In the criminal case, if you plead guilty to the charge of DUI, or if you are found guilty, you will be sentenced in accordance within the present Arizona DUI sentencing guidelines. When the State receives notification of the verdict, your driver license will be suspended for 90 days. However, if you are a first offender, or you have had no DUI convictions within the past five years, and if you took the breath, blood or other required test, and if you have been found guilty in the criminal proceeding, or you feel that such a result is likely, then you may wish to agree to a suspension of your driver license prior to or at the MVD hearing.

Agreeing to the suspension will entitle you to a 60 day restricted driving permit following a 30 day suspension. The suspension is still classified as a 90 day suspension. To obtain the restricted driving permit, you must apply at a local MVD office following the first 30 days of the suspension.  Agreeing to the suspension will generally resolve the civil proceeding sooner and oftentimes well before the resolution of your Criminal matter in court. This is advantageous as you get the suspension over with sooner and under less onerous circumstances. Agreeing to the suspension will generally result in no further suspension of your driver license if you later plead or are found guilty of your DUI in court. In the case of a stipulated suspension from MVD, there will be no requirement that you post proof of Financial Responsibility before your Arizona driver license or privilege is reinstated. Agreeing to the suspension will allow you to select the day you want your suspension to begin, so long as the suspension start date is within 45 days of your MVD hearing date. This allows flexibility in arranging transportation to work or school during the initial 30 days of the suspension. NOTE: If you request a hearing and actually go through with it and lose, the only difference is that your will not be able to choose the day the suspension begins. You should still be eligible for the 30 day driver license suspension followed by the 60 day restricted driving permit.

If you agree to the suspension, you do not get a hearing with the administrative law judge. You do not get to challenge the police officers or contest the evidence in the civil hearing. Sometimes this hearing may be important to gather critical evidence in your DUI case. However, this decision should not be made without first discussing your DUI case and individual circumstances with an experienced DUI defense attorney.

If you have the Administrative Hearing and win, and later lose your DUI case, either through a plea or finding of guilty at trial, MVD will suspend your driver license for 90 consecutive days. There is no eligibility for a restricted driving permit following the first 30 days of the suspension.  Further, if you are convicted either through a plea or finding of guilty in court you will be required to provide proof of financial responsibility (insurance) for three years by filing with the State of Arizona either a ,000 cash deposit, or Certificates of Deposit (CD’s) totaling ,000 or a Certificate of Insurance (SR22).
